6. Acceptable use
You agree NOT to:
- Use the Service for illegal or fraudulent purposes
- Provide false information about your health
- Use the Service to feed someone else (for example a minor or a person who is ill) without consulting a doctor
- Attempt to gain unauthorised access to our systems
- Use bots, scripts, or other automated means to interact with the Service
- Reverse-engineer or decompile the source code
- Redistribute, sell, or commercially exploit generated menus without written permission
- Use the Service to transmit viruses, malware, or malicious code
- Attempt to disrupt the Service (DDoS, flooding, etc.)

7. Intellectual property
7.1 Our rights
All elements of the Service (code, design, logo, name, editorial content, database) are the exclusive property of VITA SUSTENA and are protected by copyright and trademark law.
7.2 Your rights in generated menus
Menus generated specifically for you, based on the data you provided, are for personal use. You may:
- ✅ Use them to cook at home for yourself and your family
- ✅ Share them with friends/family
- ✅ Print and save them for personal use
You may not:
- ❌ Publish the menus on other commercial websites
- ❌ Sell the menus or use them commercially without permission
- ❌ Use the menus to train other AI models
7.3 The Vita Sustena brand
“Vita Sustena” and the associated logo are trademarks of VITA SUSTENA LIMITED. You may not use our name or logo without written consent.
8. AI-generated content
8.1 AI limitations
Menus are generated by artificial intelligence (OpenAI). Although the technology is advanced:
- Errors or inaccuracies may occur (for example approximate nutritional values)
- The AI may not know all allergies or food interactions
- Calorie and macro calculations are estimates, not 100% exact
- The AI may occasionally generate recipes with unusual ingredients
- Outputs may differ between successive generations
Always check ingredients and nutritional values if you have strict restrictions.
8.2 Responsibility
You accept that:
- You use the AI at your own risk
- You will verify any health-critical information with a specialist
- We are not liable for adverse reactions, allergies, or health problems caused by generated menus
8.3 Educational information about ingredients (Smart Label Reader)
Vita Sustena may highlight certain processed or packaged ingredients with a visual indicator and educational information about what to check on the label. This information:
- Is generated automatically by artificial intelligence (OpenAI) for strictly educational purposes
- Does not constitute medical or nutritional advice, or a product recommendation
- The AI may make errors or simplifications — the information is not exhaustive
- All food additives approved by EFSA (European Food Safety Authority) are considered safe within the acceptable daily intake (ADI)
- Indicated severity (“check the label”, “moderate consumption”) is guidance, not a ban
- For official information on food additives, consult EFSA or a licensed nutritionist
9. Free and paid services
9.1 Free trial
When you create an account, you receive a 5-day free trial with access to Premium features so you can evaluate the Service before any paid subscription charge. When the trial ends, continued access requires an active paid subscription unless your account is otherwise exempt (for example certain internal or promotional accounts).
9.2 Premium subscription
Premium is offered as a recurring subscription (monthly or annual). The price, billing interval, and features included are shown clearly before you complete checkout. Payment is processed by our payment provider (Creem); charges may appear on your statement under the merchant name shown at checkout.
You may cancel your subscription at any time from your account (Manage subscription). After cancellation, no further charges are made for that subscription; you keep access until the end of the billing period already paid for, unless these terms say otherwise.
9.3 Right of withdrawal (EU)
If you are a consumer in the European Union, statutory rights may apply under Directive 2011/83/EU. For digital content and services, those rights may be limited when you expressly agree to immediate access and acknowledge that you lose the right of withdrawal once performance has begun. The free trial in section 9.1 is intended to let you assess the Service before you pay. Refund eligibility for paid subscriptions is set out in section 9.4 below and does not affect rights that cannot be excluded under mandatory law.
9.4 Refunds
Because of the 5-day free trial described in section 9.1, you can use Premium before the first subscription payment. Refund rules for paid subscriptions are therefore as follows:
- Monthly subscription: no refunds. You may only cancel the subscription so that it does not renew; you retain access until the end of the current monthly period already paid for.
- Annual subscription: you may request a refund only within the first 10 calendar days from the date you paid for that annual subscription. Send your request by email to [email protected] with the email address of your account and, if available, your payment or order reference. After 10 days from payment, annual subscriptions are not refundable; you may still cancel renewal or the subscription according to section 9.2 and keep access until the end of the annual period already paid for.
Approved refunds are processed through our payment provider. Timing on your card or bank account depends on your payment method and bank. We may refuse refund requests that fall outside this policy, relate to abuse of the Service, or duplicate a refund already issued for the same charge.
10. Suspension and termination
10.1 Suspension / closure by us
We may suspend or close your account without notice if:
- You breach these Terms and Conditions
- You provide false information
- You use the Service fraudulently
- You behave abusively towards staff or other users
10.2 Closure by you
You may close your account at any time from User data → Delete account. The account is kept for 30 days and then deleted automatically. You can cancel the request during this period.
11. Limitation of liability
To the extent permitted by law, VITA SUSTENA LIMITED is NOT liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profit, opportunity, or data
- Health problems caused by following menus
- Temporary interruptions of the Service
- AI errors or inaccuracies
- Actions of third parties (cyber attacks, etc.)
Our maximum liability for any loss is limited to the amount you paid for the Service in the last 3 months.
These limitations do NOT apply in cases of:
- Gross negligence or wilful misconduct
- Personal injury caused directly by us
- Rights that cannot be excluded by law
12. Warranties and availability
The Service is provided “as is” (AS IS), without express or implied warranties regarding:
- Continuous availability (target: 99% uptime, but not guaranteed)
- Absence of errors or bugs
- Fitness for a particular purpose
- Accuracy of information
We will make reasonable efforts to keep the Service operational. We may temporarily suspend the Service for maintenance, with prior notice where possible.
13. Force majeure
We are not liable for delays or failure to perform obligations caused by events beyond our reasonable control: natural disasters, war, armed conflict, major cyber attack, pandemic, government decisions, interruptions of service providers (Netcup, OpenAI), etc.
14. Changes to the terms
We may update these terms from time to time. Minor changes will be published on this page. Significant changes will be notified by email at least 30 days before they take effect.
Continued use of the Service after changes constitutes acceptance of them. If you do not agree with the changes, you may close your account.
15. Dispute resolution
15.1 Amicable resolution
In the event of a dispute, we will try to resolve it amicably. Send your complaint to [email protected] and we will respond within 30 days.
15.2 Mediation and the ODR platform
Under Regulation (EU) No 524/2013, consumers may use the European Commission’s Online Dispute Resolution (ODR) platform:
15.3 Jurisdiction
For disputes not resolved amicably, the courts of the European Union have jurisdiction. EU law applies.
For consumers, this clause does not deprive you of the protection granted by the law of your country of habitual residence.
15.4 Consumer complaints (EU)
Consumers may contact the European Consumer Centres Network (ECC-Net):
16. General provisions
- Entire agreement: These terms constitute the entire agreement between the parties and replace any prior agreements.
- Severability: If a clause is invalid, the remainder remains in force.
- No waiver: Our failure to exercise a right does not constitute a waiver of that right.
- Assignment: You may not assign your rights/obligations without our consent. We may assign in the event of a merger/acquisition.
17. Language of the contract
These terms are drafted in English. Versions in other languages are indicative translations. In case of discrepancy, the English version prevails.
